1.4 Payments

We reserve the right to send you mobile messages which do not earn you Level 1 earnings. These messages will strictly be related to Fluc system updates, special announcements and the like. If your account is turned off, you will not receive these messages. You accept that if you cancel or terminate your account, you may not be eligible to cash out earnings accrued by your involvement with our service if they do not exceed the minimum threshold requirements. If your earnings do not exceed the minimum threshold requirements, then your account will be automatically deleted and your earnings will expire immediately. If the balance of your account exceeds the minimum threshold, then we will process this payment before deleting your account. Payment can still take up to 60 days. Your election to do this is final and cannot be reversed. You accept that if you cancel or terminate your account you may still receive some residual messages which have or still are being processed by our systems. We attempt to stop such messages from being sent, but you accept that you will receive no Level 1 as a result of these messages. We are in no way liable for damages or loss resulting from your receive these messages. We reserve the right to determine cases of suspected abuse and/or fraud and/or violation of this agreement. If your account is terminated because of suspected fraud, abuse or violation of this agreement we reserve the right to immediately terminate your membership and ban your mobile phone number. Account termination is final and cannot be reversed. If you dispute any payment made under our service, you must notify us in writing within thirty (30) days of any such payment; failure to so notify us shall result in the waiver by you of any claim relating to any such disputed payment. We reserves the right to withhold payment due to any of the foregoing or any breach of this Agreement by you, pending our reasonable investigation of any of the foregoing or any breach of this Agreement by you, or in the event that an content provider whose content you have received requests it.
1.5 No Guarantee.
Although we are a mobile phone promotional website, it is important to realise that we are not guaranteeing you income under this agreement. Your selected preferences must be matched to that of a relevant advertiser in order for us to actually send you a mobile message. You will not be sent messages that do not match your preferences. You can change your preferences at any time, but it may take our system up to 48 hours to process these changes during which time you will receive no mobile messages and earn no Level 1 earnings. You are in complete control of your account and can manage our service as required. This includes turning off your account which will result in no content delivery and no Level 1 or Level 2 earnings.
Some programs we release may be identified as "Alpha", "Beta" and/or "Experiment" or otherwise as "Unsupported". To the fullest extent permitted by law, these programs are provided "as is" and are undertaken and joined at the Members and/or End-users option and risk. Members and/or End-users shall not disclose to any third party any information from these programs, existence of features contained within these non-public programs or provide access to any of these programs.
