Unhappy geppetto

I recently ventured into opening my own business and sought the assistance of a local web design company; Toledo Web Shop. They wanted half the money to start the project and the other half on completion and only when we were completely satisfied with the final product. We gave them our deadline which was several months away and with the guarantee it was not a problem in meeting, they started. We met with the market manager several times correcting and tweaking the site but all the while grammatical and spelling errors went uncorrected. It got to the point of being ridiculous. The deadline came and went and so did the hopes of having a working website by this co. We attempted to contact and set up meetings via posting on their site and phone messages but all went unanswered. I then noticed the other half of the charges on my credit card, unauthorized of course. I contacted the credit card co. and they are investigating and I have been totally closed out of the co.'s site. I want to take them to small claims court but we are out more than the 3,000 jurisdiction Lucas County Courts allow. I thought about taking them to the Judge Mathis show or one of those as they allow 5,000 dollars. What is my recourse and how would you proceed? Thank you in advance.

Have you a contract with them, from which they have not fullfill any term?

Thank you for the warm greeting. Yes, we did have a contract that stated half the total amt paid was to initiate the web design and the other half payable only when the job was complete and we were 100% satisfied with the outcome of the completed project. Halfway through the project the errors we found had gone uncorrected and the company refused to answer phone calls, e-mails or respond to posts on their web site. We were unable to access our information and we were wiped out in their system that we once had access too.

You may sue them according terms that are not fullfilled, even for earning loss.
Then they will run to contact you.
