I am in the process of working out a loss mitigation with my bank (Bank of America) on my upside down loan. I was recently laid off (like everyone else I know.)
The process with B of A required me to give them paystubs of my wife's disability payments as well as my own. Since I was just laid off and was about to go on disability myself, I have just put in for state disability insurance. While waiting for that, I heard of a service (from a electrician doing work for my mother in law) that Greenleaf did a great job for them. So (I am so stupid I guess) called them and after a long talk, he said he would talk to the "attorneys" about my case to see if they would take it. I never gave him any ssn data like that. He then says that they charge $2,750 for the attorney to take the case which would involve checking the original loan for errors and attempting to re-negotiate the loan with B of A. He also said that he had heard of B of A just cancelling 2nd mortgages to get the loan in better shape. My questions are this; 1. I had heard that it is illegal in the state of California to offer to help you modify your loan for a fee (unless you are a lawyer.) Is this true? 2. Should I just wait to get my disability from the state before starting loss mitigation directly with B of A? Like everyone else, I am running out of money here and I would hate to spend $2,750 to greenleaf when it was something I could have done on my own. Anyone is thinking about using Greenleaf Mod. beware I think they are a scam. I have been waiting over 2 months for a response about our file and have not received anything!!!! The supervisors do not even return phone calls. They promised that the lawyer Kurt Elkins would handle everything wrong come to find out that GLM is handling it. It has been a bunch a lies!!!!!!!!!!!!!!!!!!!!!
